CONSENT TO TERMS AND CONDITIONS:

Access to and use of the services of Andrew Harper, LLC ("Andrew Harper") and our website www.andrewharper.com or other sites owned and operated by Andrew Harper, including certain subscription restrictions and limitations on liability applicable to your subscription are subject to acceptance of these terms and conditions ("Terms and Conditions"). By accessing, using or obtaining any content, products, or services through our offices or through our websites, you agree to be bound by these Terms and Conditions. If you do not accept all of these Terms and Conditions, then do not use any of our services or our websites. These Terms and Conditions govern the relationship between Andrew Harper and you, the Customer. No alterations to these Terms and Conditions may be made by any Andrew Harper employee, authorized representative or agent, unless in writing by an authorized officer of Andrew Harper.

TERMS AND CONDITIONS

TRAVEL PRICING.

All rates are subject to availability at time of booking, may include early booking discounts, and may increase without notice. Non-discountable fees such as, but not limited to, port charges are included in pricing unless otherwise stated. Airfare, air taxes, fuel surcharges, transfers, government fees and taxes are additional unless otherwise stated. A booking processing fee is additional and is subject to change without notice. Information and pricing are subject to change without notice. In the event of a pricing error, or any omission, Andrew Harper reserves the right to adjust the pricing or to make any other corrections. Every attempt has been made to include all taxes. In rare instances, certain departure taxes must be paid in cash only upon departure from a country, and may vary in price. Travel suppliers may add a fuel surcharge, and Customer agrees to pay it.

CUSTOM ITINERARIES.

Custom itineraries are packages specifically designed for the traveler by our Travel Office and include hotels, tours and transportation. For more information on planning with the Andrew Harper travel office, please visit this page.

TRAVEL DOCUMENTATION.

Travel documentation proof appropriate for entry to itinerary destination(s), such as passports, visas and inoculation certificates remain each traveler's responsibility. Andrew Harper is not responsible for providing documentation information. Customer should verify requirements well in advance of travel to ensure compliance. Travelers who do not meet these requirements will be denied boarding by cruise lines and airlines. If a passport is required, the expiration date must be at least six (6) months following the return date of the planned travel. For further information, visit the U.S. State Department website, http://travel.state.gov, on a regular basis for updates regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States. PLEASE NOTE THAT U.S. GOVERNMENT RULES REGARDING ENTRY AND EXIT CHANGE ON A DAILY BASIS. VERY IMPORTANT: SOME DESTINATIONS CURRENTLY REQUIRE THAT YOUR PASSPORT NOT EXPIRE WITHIN SIX (6) MONTHS OF THE DATE OF YOUR ITINERARY RETURN. ALL UNITED STATES CITIZENS ARE REQUIRED TO HAVE A VALID PASSPORT TO TRAVEL ANYWHERE OUTSIDE THE UNITED STATES. THIS INCLUDES THE CARIBBEAN, BERMUDA, MEXICO, PANAMA, CANADA, AND ON ALL CRUISES. VISAS MAY ALSO BE REQUIRED FOR SOME DESTINATIONS. REMEMBER, EACH CHILD TRAVELING WITH YOU REQUIRES INDIVIDUAL TRAVEL DOCUMENTATION AS WELL. (CAUTION: IF ANY WATERMARKS APPEAR THAT WILL AFFECT PASSPORT MACHINE READERS, REPLACE IT PRIOR TO TRAVEL DATE.) It is the responsibility of the Customer to make Andrew Harper aware when he or she is traveling on a passport from a country other than the United States. Andrew Harper, LLC is registered to sell travel in the following states; California #2110806-40, Iowa #1096, Washington #603248672. This seller of travel is not a participant in the California Travel Consumer Restitution Fund. California law requires certain sellers of travel to have a trust account or bond. This business has a trust account.

HEALTH MATTERS.

Health matters, including, but not limited to, concerns related to norovirus, should be addressed to the following: a) your personal physician, b) the cruise line you selected, and c) the U.S. Centers for Disease Control. Andrew Harper is not responsible for providing inoculation information. Customers traveling to areas where vaccination(s) may be required are responsible to check medical requirements for wherever they may venture. REQUIRED OR ADVISED INOCULATIONS YOU DECIDE TO OBTAIN UPON THE ADVICE OF YOUR PERSONAL PHYSICIAN MAY NEED TO BE ADMINISTERED IN A SERIES OF DOSES MONTHS AHEAD OF YOUR PLANNED DEPARTURE, AND SUCH TIME ELEMENT SHOULD BE TAKEN INTO ACCOUNT BY YOU WHEN MAKING DEPOSITS AND/OR NONREFUNDABLE FINAL PAYMENTS. TRAVEL CANCELLATION POLICIES AND FEES.

IT IS THE CUSTOMER'S RESPONSIBILITY TO KNOW AND UNDERSTAND THE THIRD-PARTY TRAVEL SUPPLIER'S ("SUPPLIER") AND ANDREW HARPER'S CANCELLATION PENALTIES. YOU MAY VISIT THE SUPPLIER'S WEBSITE TO VIEW THOSE POLICIES. THE CANCELLATION POLICIES AND FEES OF ANDREW HARPER ARE SET FORTH AS FOLLOWS: SHOULD YOU WISH TO CANCEL YOUR TRAVEL PLANS, YOUR RIGHT TO A REFUND IS LIMITED BY THE SUPPLIER TERMS AND ANDREW HARPER'S POLICIES. ANDREW HARPER WILL REIMBURSE YOU DIRECTLY. THE SUPPLIER AND ANDREW HARPER MAY CHANGE THEIR CANCELLATION POLICIES AT ANY TIME. CANCELLATIONS ARE SUBJECT TO THE PROTECTION OF AGENCY REVENUE. ANDREW HARPER RESERVES THE RIGHT TO TREAT THE BOOKING AS CANCELED IF THE BALANCE DUE IS NOT PAID ON TIME. AS A RESULT OF SUCH CANCELLATION, ANDREW HARPER'S AND SUPPLIER'S CANCELLATION PENALTIES WILL APPLY, WHICH ARE DETAILED IN YOUR TRAVEL DOCUMENTATION, THE SUPPLIER WEBSITE AND THE WWW.ANDREWHARPER.COM WEBSITE. ALL CANCELLATION FEES WILL BE CHARGED TO THE CREDIT CARD YOU AUTHORIZED TO PAY FOR TRAVEL SERVICES, INCLUDING CANCELLATION FEES, OR DEDUCTED FROM THE SUPPLIER'S REFUND. ANDREW HARPER RESERVES THE RIGHT TO CHARGE A CHANGE CHARGE. INDIVIDUAL STATE LAWS, IF ANY, REGARDING CANCELLATIONS AND REFUNDS APPLY.

TRAVEL PROTECTION PLAN OF INSURANCE.

ANDREW HARPER STRONGLY RECOMMENDS THE PURCHASE OF A TRAVEL PROTECTION PLAN OF INSURANCE SERVICES THAT PROTECTS YOU AND YOUR PARTY, INCLUDING:

• TRIP CANCELLATION/INTERRUPTION
• CANCEL FOR ANY REASON
• JOB LOSS PROTECTION
• EMERGENCY MEDICAL EVACUATION/EMERGENCY TRANSPORTATION
• TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES
• TRIP DELAY
• TRIP COST SUPPLIER DEFAULT
• BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE

TRAVEL INSURANCE SHOULD BE PURCHASED FROM VARIOUS THIRD-PARTY TRAVEL INSURANCE SUPPLIERS AT THE TIME TRAVEL ARRANGEMENTS ARE MADE. REVIEW THE COVERAGE AND POLICIES CAREFULLY. IT IS CUSTOMER'S RESPONSIBILITY TO PURCHASE COVERAGE DIRECTLY FROM THE THIRD-PARTY TRAVEL INSURANCE SUPPLIER.

TRAVEL DOCUMENTS.

You will receive travel documents prior to the departure date. When you receive your tickets and any and all documents, it is the sole responsibility of the Customer to review and verify all information. Contact Andrew Harper immediately if changes or corrections are required.

RESPONSIBILITY, DISCLOSURE AND LIABILITY LIMITS.

ANDREW HARPER IS NOT THE SOURCE OR SUPPLIER OF THE TRAVEL SERVICES REQUESTED, AND ACTS SOLELY AS AN AGENT FOR DISCLOSED PRINCIPAL SUPPLIER CRUISE LINES, HOTELS, AIRLINES, AIR CHARTERS, BUS COMPANIES, GROUND TRANSPORTATION, BOAT PURVEYORS OR OWNERS, AND OTHER INDEPENDENT CONTRACTORS PROVIDING ACCOMMODATIONS, TRANSPORTATION, AND/OR OTHER SERVICES. EACH OF THESE COMPANIES IS AN INDEPENDENT ENTITY WITH ITS OWN MANAGEMENT, AND IS NOT SUBJECT TO THE CONTROL OF ANDREW HARPER. ANDREW HARPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LOSSES, WHETHER IN CONTRACT, TORT OR OTHERWISE. ANDREW HARPER IS NOT RESPONSIBLE OR LIABLE FOR ANY NEGLIGENT ACTS OR DEFAULTS OF A SUPPLIER OR ANYONE ELSE NOT UNDER OUR CONTROL. CUSTOMER IS ADVISED THAT THE SUPPLIERS WHOSE NAMES APPEAR IN TRAVEL DOCUMENTATION ARE THOSE ACTUALLY RESPONSIBLE FOR PROVIDING THE TRAVEL SERVICES PURCHASED, AND CONSENTS TO THE USE OF THOSE SUPPLIERS, AND UNDERSTANDS AND AGREES EACH SUPPLIER'S TERMS AND CONDITIONS ARE CONTAINED IN PRINTED FORM AND/OR ON THEIR RESPECTIVE WEBSITES GOVERNING THE TRANSACTION. ALL BOOKINGS ARE ACCEPTED BY ANDREW HARPER AS AGENT FOR INDEPENDENT THIRD-PARTY TRAVEL SUPPLIERS IN YOUR ITINERARY. TRANSPORTATION, ACCOMMODATIONS AND OTHER SERVICES PROVIDED BY THE IDENTIFIED SEA, AIR AND OPERATORS OFFERED ARE SUBJECT TO THE TERMS AND CONDITIONS CONTAINED IN THE TICKETS, EXCHANGE ORDERS OR VOUCHERS ISSUED BY THEM AND/OR THEIR SUPPLIERS, INCLUDING TERMS AND CONDITIONS ON THEIR RESPECTIVE WEBSITES. BECAUSE ANDREW HARPER DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF THE INDEPENDENT OPERATORS AND THEIR SUPPLIERS, IT IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. ANDREW HARPER IS NOT RESPONSIBLE FOR THE WILLFUL OR NEGLIGENT ACTS AND/OR OMISSIONS OF SUCH SUPPLIERS OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES. CUSTOMER'S RETENTION OF TRAVEL DOCUMENTS, RESERVATIONS, OR BOOKINGS AFTER ISSUANCE SHALL CONSTITUTE CONSENT TO THE ABOVE, AND FURTHER, THAT ANDREW HARPER SHALL NOT BE LIABLE FOR ANY ACCIDENT, INJURY, PROPERTY DAMAGE, OR PERSONAL LOSS TO CUSTOMER OR TO THOSE TRAVELING WITH CUSTOMER IN CONNECTION WITH ANY ACCOMMODATIONS, TRANSPORTATION, OR OTHER TRAVEL SERVICES OR RESULTING DIRECTLY OR INDIRECTLY FROM ANY OCCURRENCES OR CONDITIONS BEYOND ITS CONTROL, INCLUDING, BUT NOT LIMITED TO, ACTS OF GOD, FIRE, ACTS OF GOVERNMENTS OR OTHER AUTHORITIES, WARS, CIVIL DISTURBANCES/UNREST, RIOTS, STRIKES, EPIDEMICS, QUARANTINES, ACTS OF TERRORISM, DEFECTS IN VEHICLES, BREAKDOWN IN EQUIPMENT, STRIKES, THEFT, DELAY, WILDLIFE, OR CANCELLATION OF OR CHANGE IN ITINERARY OR SCHEDULES. WEATHER CONDITIONS, INCLUDING BUT LIMITED TO, THE PRESENCE OR ABSENCE OF SNOW, SUNSHINE, AND RAINFALL ARE NOT GUARANTEED TO OCCUR OR NOT OCCUR, AND ARE CLEARLY OUTSIDE OF THE CONTROL OF ANDREW HARPER.

ANDREW HARPER RESERVES THE RIGHT TO CANCEL ANY ITINERARY OR ANY PART OF IT, TO MAKE SUCH ALTERATIONS IN THE ITINERARY AS IT DEEMS NECESSARY OR DESIRABLE, TO REFUSE TO ACCEPT OR TO RETAIN AS A SUBSCRIBER OF ANY TOUR ANY PERSON AT ANY TIME, AND TO PASS ON TO CUSTOMERS ANY EXPENDITURE OCCASIONED BY DELAYS OR EVENTS BEYOND ITS CONTROL. IN CASE OF ANY APPRECIABLE VARIATION IN ITS COST, ANDREW HARPER RESERVES THE RIGHT TO ADJUST ITS RATES.

TRAVEL DESTINATIONS.

ALTHOUGH MOST TRAVEL, INCLUDING TRAVEL TO INTERNATIONAL DESTINATIONS, IS COMPLETED WITHOUT INCIDENT, TRAVEL TO CERTAIN DESTINATIONS MAY INVOLVE GREATER RISK THAN OTHERS. ANDREW HARPER URGES PASSENGERS TO REVIEW TRAVEL PROHIBITIONS, WARNINGS, ANNOUNCEMENTS AND ADVISORIES ISSUED BY THE UNITED STATES GOVERNMENT PRIOR TO BOOKING TRAVEL TO INTERNATIONAL DESTINATIONS. BY OFFERING TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, ANDREW HARPER DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND ANDREW HARPER IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

You will indemnify and hold Andrew Harper, its parents, subsidiaries, affiliates, licensors, licensees, customers, content providers, service providers, employees, agents, officers, directors, contractors and lawyers ("Indemnified Parties") harmless from any breach of these Terms and Conditions by you, including any use of content from the site other than as expressly authorized by us in these Terms and Conditions. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use. HARPER AUCTIONS AND PRIVATE SALE.

By continuing to use the Harper Auctions, and the pages and services herein, (collectively the "Service"), you agree to the following terms and conditions ("Terms and Conditions").

The Harper Auctions give Andrew Harper subscribers the opportunity to purchase luxury travel experiences at impressive savings. Participants must be current subscribers of Andrew Harper to bid. If you are not yet a subscriber, please click here to join or call our Client Relations Office at (800) 235-9622 prior to bidding.

Please refer to the retail value of the auction, the minimum bid, and the high bid before submitting a bid. New bids must exceed the minimum bid or high bid, whichever is higher, by at least $10 to qualify. All bids must be placed online on the Harper Auctions website. Outside emails and phone bids cannot be accepted. Subscribers may submit one bid or multiple bids during the auction. Each bid is recorded at the time it is received. Subscribers may also opt to place an "Automatic Bid" that will increase by $10 increments until it is the high bid or the maximum value has been reached. If the bid is no longer the highest bid, an "Outbid" notification will be sent via email. Bids may be placed until the close of an auction.
